How To Start A Company or Business In Germany In 2022?

Starting a business, company or startup is neither easy nor difficult. You just need to be aware of the rules & regulations. It’s an additional perk if you are able to speak or understand German.

We are sharing with you a step-by-step guide which will help you to start a business in Germany. This 9-step guide is specially written for freelancers and sole proprietors.

Step 1: Register Your Address

Whenever you move to Germany, you need to register your new address. This is referred to as the Anmeldung.

When you first register your address, you’ll receive a tax ID and a certificate of registration. To register your business with ELSTER, you’ll need a tax ID and a registered address.

Step 2: Open A Bank Account

To register your company and pay your taxes later, you’ll need a bank account. It is not necessary to have a German bank account; any bank account that allows SEPA transfers would suffice.

A separate business account is required when forming a corporation (GmbH, UG, AG, or KGaA). You do not need a business account if you’re a Freiberufler or a Gewerbe.

You have the option of using your personal bank account. Having a company account is still a smart idea because it simplifies accounting.

Step 4: Freiberufler & Gewerbe Registration

If you want to register a Gewerbe, you must first obtain a trade license before registering with the Finanzamt.

A Gewerbeschein can be applied for online in Berlin. Before you do this, you must have a valid residency permit.

You can use the hard copy in the rest of Germany. You can also have your tax advisor handle it for you.

Step 5: Get A Trade License

If you want to register a Gewerbe, you must first obtain a trade license before registering with the Finanzamt.

A Gewerbeschein can be applied for online in Berlin. Before you do this, you must have a valid residency permit.

You can use the hard copy in the rest of Germany. You can also have your tax advisor handle it for you.

Step 6: Register Your Business With Finanzamt

Now next step is to file a business declaration with the Finanzamt. Fill out the Fragebogen zur steuerlichen Erfassung to do so.

You must complete this online starting in 2021. Your tax expert can help you register your company.

Step 7: Get The Residence Permit

In order to work as a self-employed person in Germany, you may need a residence visa. It is contingent on your nationality.

Step 8: Connect Health Insurance

If you already possess health insurance, you should inform your provider that you will be working as a freelancer. Every month, the insurance provider will deduct money from your bank account.

The cost of health insurance for freelancers is higher. If you work for yourself, private health insurance could save you a lot of money.

Step 9: Website Is Compulsory

If you have a website, ensure that it complies with all German and European regulations. Damage claims may be filed against website operators if an Impressum is omitted or photographs are erroneously attributed.
