Is Elon Musk’s Role as DOGE Head Unconstitutional? 14 US States File Lawsuit

A federal lawsuit has been filed by 14 US states challenging the appointment of Elon Musk as chief of the Department of Government Efficiency (DOGE) and accusing it of violating the Constitution.

The coalition led by New Mexico argues that Musk is entrusted with extraordinary powers to overhaul federal agencies and trim the workforce which violates the constitutional separation of powers. The suit contends that significant power such as this needs formal nomination from the President and consequent confirmation by the Senate as per the Appointments Clause of the US Constitution. 

The plaintiff characterized Musk as a “self-proclaimed agent for chaos” expressing apprehensions regarding democratic backsliding and concentration of power in the hands of an unelected individual.

They stated that the President cannot create or disband federal agencies (the actions Musk undertook are thus illegal) while Musk and President Trump maintain that DOGE was merely trying to get rid of inefficiencies in government and provide recourse against corruption in federal departments.
