Delhi HC, Right To Travel A Valuable Fundamental Right

On February 3, the Delhi High Court said that the right to travel is a valuable fundamental right. Permitted a person convicted in a case registered under the Prevention of Corruption Act to travel to Dubai.

The High Court said that the right to travel can be reduced only in some extraordinary circumstances.

According to LiveLaw, the court in its order said, “The right to travel is a valuable fundamental right and should be curtailed only in exceptional circumstances. The pendency of an appeal where the sentence has been suspended does not amount to an extraordinary circumstance.”

During the verdict of Nitya Nand Gautam who wanted to travel to Dubai, a single bench of the court headed by Justice Jasmeet Singh permitted him to do to Dubai. The court gave him one month to meet from 15 February to 15 March in Dubai.

Let me tell you that Gautam was convicted by the trial court under sections 409, 420, and 120B of the IPC and sections 13(1)(c) and (d) of the Prevention of Corruption Act, in October 2020. He was sent to jail for a long period of three years. He was also fined one lakh rupees.

In 2022 the month of December Gautam appealed to the court and asked for permission to visit Dubai.

After this, the court ordered and allowed Gautam to travel after furnishing a personal and surety bond of Rs one lakh each. The court further said that Gautam should give his mobile number to the investigating officer to proceed. And the court said that the number should be in working condition and that Gautam is not allowed to switch off the phone without informing investigating officer.
